A Historical View on the Law Profession

history of the law profession

The work in The law profession started in the old times in Greece. And the place in which the lawyers were meeting, was a  holy place as it was sprinkled with pure water to indicate that everything in that place - whether sayings or deeds - should be pure. The law profession continutes to develop as in the Romans era, King Aftimos issued a law that makes lawyers equal to the Army men as he said "There is no difference between those who protect our country by their weapons and those who protect our people by their pens and tongues".

And in the Arabic countries, before Islam, when a dispute happened between two or more parties, a man with a good logic and fluency represented each party in order to explain the case to the judge. And when Islam came, it approved this, but our prophet Mohammed - peace and blessings of Allah be upon him - warned from deception while showing and explaining the case, as it is forbidden for any lawyer to use his or her good fluency and cleverness to deceive the judge in order to win the case. If this happens and a lawyer wins their case by deception, it will be as if they and their client have won a part of the hellfire.

So the Islamic Law came to make a balance regarding this, as Allah has said in Surat Al-Nisaa (The Women, verse 105) "Indeed, We have revealed to you, [O Muhammed], the Book in truth, so you may judge between the people by that which Allah has shown you. And do not be for the deceitful an advocate."

A lawyer should protect their client and advocate them to the highest degree if their client has the right in his or her lawsuit. But if the client doesn't have any right, the lawyer should be honest and brave enough to convince them that they should reconcile with the other party.

The legal profession is a profession of keeping harm away from people. It is the profession of dignity and honour, and a good laywer should be distinguished by honesty and faithfulness.
